United files suit on SoonerSelect

United Healthcare of Oklahoma filed suit against the Oklahoma Health Care Authority (OHCA) on July 12 in Oklahoma County District Court. United is requesting OHCA produce the procurement records for the RFP for SoonerSelect. The claim was filed alleging violation of the Oklahoma Open Records Act. Judicial relief is requested for the following items:
•    OHCA to comply with United’s Open Records Act requests for inspection or a release of the documentation around the procurement decisions.
•    Declare United has not exceeded the window for an administrative protest of the contract awards for SoonerSelect.

On July 18, a status update was filed with the court stating that talks are ongoing with United and OHCA for the requested open records and they expect resolution. No court hearings have been scheduled but another status update will be provided to the court on Aug. 1.  

It is important to note this litigation does not impact the implementation of SoonerSelect and the ACR program. United has not asked the court to stop the implementation process, so it is proceeding.
