State electronic prescribing of all controlled dangerous substances mandate begins Jan. 1

On May 8, 2018 Gov. Mary Fallin signed HB2931 requiring electronic prescriptions. HB2931 states that, effective Jan. 1, 2020, electronic prescribing shall be utilized for all controlled dangerous substances in Schedules II, III, IV, and V.

There can be exceptions made. The electronic prescription requirement provided for in 63 O.S. 3-309 shall not apply to prescriptions for controlled dangerous substances issued by any practitioner listed in 63 O.S. 2-309(A)(5) and under the circumstances provided for in 63 O.S. 2-309(A)(6). Exceptions must be applied for by each individual practitioner, not by the hospital, to their licensure board.  

The Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD) has produced a Frequently Asked Questions document. This should answer most questions that you have about compliance. OBNDD is updating their FAQs as more questions arise.

The law places the licensing boards with the authority to grant waivers. For the process with each licensure board, check with that individual licensure board for the relevant profession.  

To apply for a one-year waiver, click here. If your application for waiver is approved by the Oklahoma Medical Board, your waiver will be valid for one year after the date approved. You will be notified if your application is approved or denied. Not all licensure boards are giving the same one-year waiver.

Each prescriber will receive a prescription pad printed by OBNDD mailed to them by the end of 2019. Make sure your address and all other information is correct in their database. The OBNDD website contains the following resources on prescription pads that must now be used for all CDS:

OHA attended a meeting with the licensing boards and the following statistics were given as of Dec.12:
  • Oklahoma Medical Board has issued 225 waivers for MDs and PAs. The 225 includes 11 waivers for podiatrists.
  • Oklahoma Osteopathic Board has issued 50 waivers for DOs.
  • Oklahoma Dental Board has issued 1,000 waivers for DDS.
